Terms and Conditions

Terms and Conditions for Evans Guitar Lab

Effective Date: 5th April 2025

These Terms and Conditions ("Agreement") govern the use of repair services provided by Evans Guitar Lab, located at 20 Caederwen Road, Neath SA11 1UY, referred to as "the Company," "we," "our," or "us," and the customer ("Customer," "you," or "your"). By submitting a guitar for repair or service, you agree to abide by these Terms and Conditions. “written, writing” refers to electronic and paper communications.

1. Scope of Services

We offer professional guitar repair, setup, and modification services. The services provided are outlined in the work order or service request submitted by the customer. We will make reasonable efforts to complete the work as per the requested service specifications, but any additional work, parts, or changes to the original request will require prior written approval from the customer.

Evans Guitar Lab reserve the right to refuse to undertake work without reason.

2. Estimates and Pricing

  • Estimates:      An estimate of the cost for repairs or modifications will be provided      before any work is done. However, all estimates are subject to change      based on the condition of the guitar or any unforeseen complications.
  • Pricing:      All pricing for services is based on labour rates and the cost of parts      (if applicable). Starting prices are shown on the Website and are subject      to change without notice.
  • Deposit:      A deposit of at least 25% of the estimated cost may be required before      work begins on repairs, especially for extensive work or custom      modifications.
  • Final      Payment: Payment is due upon completion of the work, before the guitar      is returned to the customer. We accept cash and Bank Transfer.

· Strings: “ + / Plus Strings” means you are to pay for the cost of the strings that you chose and any additional costs incurred by that choice such as delivery from manufacturer/ distributor, replacement Nut, Bridge etc.

3. Repairs and Modifications

  • Customer      Responsibility: The customer is responsible for providing accurate      details about the issues or desired modifications for the guitar. Any      issues or repairs not disclosed may lead to additional charges.
  • Parts      Replacement: If parts need to be replaced, we will use parts of      similar quality or better, unless the customer specifies a particular      brand or model.
  • Workmanship      Guarantee: We provide a 30 day guarantee on all repairs and services.      If the work is found to be defective within this time frame, we will      correct the issue at no extra charge. This guarantee does not cover      damages resulting from accidents, misuse, or wear and tear.

· Settlement time: guitars are made from wood and this is a natural material that will change shape and form depending on external factors such as temperature and moisture. All guitars will be set up at Evans Guitar Lab at the room temperature. Changes in set up due to conditions outside of Evans Guitar Lab (the physical location) are not the responsibility of Evans Guitar Lab. However, we are happy to have a conversation on how to work with these changes.

  • Part      warranty: We will not be held responsible for failure of parts installed      that are manufactured by other companies.

4. Turnaround Time

We will provide an estimated completion time for the repair or service when the work order is accepted. While we strive to meet these timeframes, delays may occur due to unforeseen circumstances. Delay may be due to the nature of sole trading (ill health etc.), part delivery, setting times for specific finishes etc. The customer will be informed of any delays as soon as possible.

5. Customer-Owned Instruments

  • Condition      of Instruments: It is the customer's responsibility to ensure that the      guitar is in a safe, transportable condition when dropped off for repair.      The company is not responsible for any pre-existing damage to the      instrument unless it is noted on the service request.
  • Storage:      Guitars that are not picked up within 14 days of notification of      completion will incur a storage fee of £5.00 per day.

6. Liability and Limitations

  • Damages:      While we take every precaution to handle all instruments carefully, the      customer acknowledges that there are inherent risks in guitar repairs and      modifications. The Company will not be held liable for damage to the      instrument during repairs, except in cases of gross negligence.
  • Warranty      Disclaimer: We do not guarantee the longevity of any repairs or      modifications, as usage, handling, and environmental factors may affect      the performance of the guitar after work is completed.

7. Cancellations and Refunds

  • Cancellations:      If a customer decides to cancel a service after it has been initiated,      they may be required to pay for the labour and parts used up to that      point.
  • Refunds:      Refunds for services provided will only be issued if the repair is deemed      to be faulty within the 30 day warranty period. Refunds will not be      provided for issues unrelated to our work.

8. Ownership and Use of Parts

  • Any      parts replaced during a repair service remain the property of the Company      unless otherwise agreed upon in writing.
  • If      the customer requests to keep the replaced parts, the customer may be      charged for those parts, and they must be collected upon payment of the      service.

9. Privacy and Data Protection

We respect your privacy. Any personal information provided for the purpose of the repair service (e.g., name, contact information) will be kept confidential and used only for the purposes of processing the service request and communication with the customer. We will not share your personal information with third parties without your consent, unless required by law.

10. Governing Law and Dispute Resolution

This Agreement will be governed by the laws of the United Kingdom. Any concerns over services should be address directly to Ian@EvansGuitarLab.com in the first instance.

11. Changes to Terms

The Company reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website or communicated directly to customers. The terms and conditions in effect at the time of service will apply to the transaction.

By submitting your instrument for repair or service, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
